Patrick McClintock, 20, a junior majoring in mechanical engineering, was charged with disturbing the peace after video circulated online showing him yelling a slur and tossing coins toward Portnoy outside Boardtown Pizza & Pints during MSU’s football weekend.
The Starkville Police Department said they were alerted to the footage showing an individual “yelling an antisemitic statement and throwing coins toward another person outside a local business.” A warrant was issued and McClintock was later taken into custody. He was booked and released on $2,500 bond.
Police noted that while offensive speech is often protected under the First Amendment, behavior that causes a public disturbance or poses safety risks may result in criminal charges.
Portnoy, who is Jewish, said incidents of antisemitism are something he encounters regularly and described the encounter as part of a larger cultural trend.
Following the incident, McClintock withdrew from Mississippi State University, according to university newspaper The Reflector and later confirmed by reporting from the New York Post.
The case remains under review.
Free speech is sacrosanct, but millionaire Dave Portnoy, once again, cries #antisemitism + guts #freeSpeech & gets 20yo Patrick McClintock arrested for using words, "disturbing the peace."

Why is @stoolpresidente above taunt + criticism? He can heckle but can't be heckled back? pic.twitter.com/6eNa2YiXzA
